So, I'm seeing a solicitor tomorrow regarding the CSA. It's at the stage were they have issued an application to the Sheriff's Court, for a 'Liabilty Order' against me. What does that actually mean then ?. Well, it will open up various doors for the CSA to do basically whatever they want to me. Take my driving licence, passport, bailiffs in, even prison. Next year they will even be allowed to do that plus, freeze bank accounts, place a curfew to name but a couple of things. Without even going to court !!!

As I've mentioned in previous posts. I'm all for a 'Non Resident Parent' (NRP), paying for their children. What I'm not in favour of, is it being Government lead. It being used to pay the social security benefits for a 'Parent With Care' (PWC). I use the term 'Parent With Care', in it's loosest possible form  . As of 27th of October last year, a PWC, who is on benefits can keep up too £20.00 of any monies paid by the NRP. So, if you are an NRP, paying £200.00 per week. The the PWC still only keeps £20.00 of that. The rest pays for what ever benefit the PWC is on. Obviously it's a different case if the PWC is working full time. They then get too keep all monies paid by the NRP. Which is right, and proper in my eyes . 

Anyway, I won't harp on about it too much. As it's a very touchy subject with me, and I'd probably end up all annoyed, and upset. Back to the 'Liability Order'. If this is granted, then it actually makes the debt legal. So, it follows that without a 'Liability Order', the debt is not legal, mmmmm . So, how come the Goverment can put both an NRP, and a PWC, through so much crap without the debt actually being fully legal ?. Simple, they incorporate everything within the Child Support Act 1991, and Family Law. Knowing full well, that it will just confuse the hell out of anyone, even solicitors.

Even in the application for the 'Liability Order', it instructs the Judge / Sheriff. That "under Section 33 of the Child Support Act 1991, the validity of the maintenance assessment may not be questioned", and "The sheriff must make the Liability Order if satisfied that the payments in question have become payable, and have not been payed". How's that from British Justice ???.

Basically, that takes away your right to defence. Which is a breach of your civil rights as a citizen of the UK. Also a breach of  the constitution of the UK.  It's basically the Government saying sod the law, sod your position as a sheriff, do as you're told. The consitution states that any person having to apear in court for any reason, must be given the right to a defence. So, obviously the UK Government think nothing of it's own constitution.

A recent court case regarding CSA, and how they deal with assessments came up with a rather suprising outcome. It turns out that CSA have no legal "Duty Of Care" to make sure that their assessments are correct. That was actually a case of a PWC, taking the CSA to court. For not paying her enough money.  Don't you just love being British, lmfao.

Last September, I wrote to CSA and asked for all information they had on my under the 'Freedom of Information Act' (FIO). They have 40 !!!! days from the date of the letter you send, to reply to you with all of your data.  Not 40 working days, actually 40 days. Needless to say, it took rather longer than 40 days for mine to arrive, this is a breach of law. I recieved no letter to say they would take longer or anything like that. It took around 91 days for mine to arrive. This stops people from mounting a proper defence of any complaints they have about their CSA account. Just as a matter of interest I received over 1300 seperate peices of paper, with information about my CSA account.

Needless to say, it takes some time getting through it all. You don't get it all in order, you have do sort that out yourself. What it does do, is let you know exactly what they have said about you. What decisions they have made, why they made them. It also gives you the oppertunity to see what they have left out. So, it's no surprise I have found some very interesting things out going through my files. I won't go into them now, but hopefully the solictor will find them of use. If they turn out to be of use, then I will ofcourse talk about them here, If you find yourself in the same position, then maybe it will help you out too.

Anyway, rant over for tonight. Hopefully all will go well tomorrow at the solicitors, and another little blow to the CSA will happen, on behalf of all NRP's & PWC's.
